Appointed under the Criminal Justice Act (CJA) to represent the petitioner in a habeas case pending in the United States District Court for the Eastern District of New York. Researched and wrote an ext ... ensive Memorandum of Law and Reply brief challenging a depraved murder conviction arising out of a drunken driving incident in which the victim was the wife of a New York City police officer. The habeas petition raised errors constituting ineffective assistance of appellate counsel rising to the level of due process violations. The federal court ruled that it would grant the habeas petition, if necessary, after a New York State appellate court rules on the issue. The case and decision were reported in the Wall Street Journal. Subsequently, I raised the issue before the New York Appellate Division, and it is now before the New York Court of Appeals. I will be arguing the case in Albany on February 9, 2012.
