OUTCOME: The court denied defendant's motion for summary judgment at 418 F. Supp. 112 (E.D.N.Y. 2005). Therafter the case settled.
I represented a luxuruty jewelry rental business seeking to recover the value of its rented jewelry stolen during the shooting of a rap video in Queens, New York.
OUTCOME: We prevailed for Wildenstein on appeal.• DeWeerth v. Baldinger, 836 F.2d 103 (2d Cir. 1987).
I represented Wildenstein & Co., an art dealer, in dispute over ownership of a Monet painting. A German woman claimed that a Monet painting Wildenstein sold in the late 1950's to a customer in New Yor ... k, in fact belonged to her and had been stolen from her castle in Germany by American soldiers in the aftermath of WWII. The district court found in favor of the German woman. The Second Circuit reversed in my client's favor, finding that the statute of limitations had run. The case raised a question of first impression as to how to interpret New York's statut e of limitations where stolen chattel is purchased by someone ating in good faith before the victim of the theft can recover.
