Your arrest will always be on your record but, even though the case was dismissed without prejudice, too much time has elapsed under Speedy Trial...

They do not have to file a criminal complaint before you get the target letter. If the grand jury indicts you, you will receive a summons to appear...

Definitely if you "didn't see them stop" you were driving carelessly. You are supposed to be aware of the car ahead of you at all times.
