For example, Lindsay represents individuals in their claims and appeals for Social Security Disability benefits, Personal Injury, Long-Term Disability Benefits, PERA disability Benefits, and other civil torts like breach of contract. She handles all stages of these claims before New Mexico state and federal courts and governmental agencies, including to conduct pre-suit investigations, prepare settlement demands, prepare and file initial applications and complaints, conduct discovery, pursue pre- and post-judgment motions, attend hearings and arbitration, mediation, and settlement proceedings, conduct bench and jury trials, collect on judgments, and pursue and defend against appeals. Lindsay also offers estate planning, including to prepare wills, trusts, transfers on death deaths, advanced health care directives, and powers of attorney.
Besides representing individuals, Lindsay also serves the civil litigation and transactional needs of businesses (from sole proprietors to international corporations) in a diverse array of industries, including, for example, car and retail sales, banking, construction, health and medicine, manufacturing, logging, real estate, and education. To that end, Lindsay represents plaintiff and defendant businesses in all stages of civil litigation, including to defend them against claims for torts and violations of the New Mexico Unfair Practices Act, auto liability, personal injury, premises liability, worker’s compensation, and employment discrimination. As plaintiff’s counsel, she helps businesses pursue their commercial claims involving contract disputes, collections and foreclosures, and trademark infringement.
Lindsay also assists businesses with their transactional needs, including by, for example, drafting, negotiating and reviewing contracts, preparing UCC filing statements and continuances, registering trademarks, and preparing mechanics’ and materialmen’s liens.
Lindsay is licensed to practice law in the New Mexico state courts, the United States District Court for the District of New Mexico, the United States Bankruptcy Court for the District Court of New Mexico, and the Tenth Circuit Court of Appeals. She is also a member of the Montana State Bar.
