John R.G. Smith v. U.S. Customs and Border Protection, 741 F.3d 1016, 2014
Jan 09, 2014OUTCOME: My Amicus Brief achieved its purpose: the court left the door open to future challenges of expedited removal by other Canadians with different facts.
In this 9th Circuit Court of Appeals case, I authored Amicus Brief for Bellingham/Whatcom Chamber of Commerce, British Columbia Chamber of Commerce, Northwest Economic Council, and Pacific Corridor Ent ... erprise Council arguing against a blanket finding of unchallengable expedited removal for Canadians. Although the court ultimately rejected the Petitioner’s merits argument, the case opens the door to future challenges of expedited removal by other Canadians with different facts. Thus the Amicus Brief was achieved its purpose.
