Ken Reed, working for a food delivery service, climbed up on the side of the refrigerated truck to withdraw frozen food for the customer. The truck design forced him to use his free hand/arm to hold on... to the truck while he reached in with the other, leaving him no way to protect himself. Wind suddenly blew the heavy refrigerated door closed, hitting him on the back of the head, causing spinal and brain injuries, and ending his ability to support his wife and two daughters. The claim was that the design of the truck was defective, and many prior accidents of this type had happened in the past, but the company had ignored the risk. The defenses were that Reed was faking the extent of his injuries and that there had never been anything causing injury like this before. RESULT---after dozens of depositions, the history of prior known risk was proven, and the company agreed to settle the claims. THEN the workers compensation insurer wanted to receive several hundred thousand dollars of the settlement, resulting in a second level of litigation, including a Medicare set-aside agreement, before the case was fully resolved. This was a complex case with an excellent result for our clients, Mr. and Mrs. Reed and their children.
