OUTCOME: N.Y. CITY JURY RETURNED A VERDICT OF $5.6 MILLION

The verdict consisted of an award of: $2,360,000 for the patient's loss of income; $3,100,000 for the patient's pain and suffering, including loss of life's enjoyment; and $120,000 for the patient's wi ... fe's claim for loss of her husband's services and consortium. This is the second largest verdict ever for LASIK malpractice. The jury's award of $3,100,000 is the largest amount ever obtained for any LASIK patient's pain and suffering, including loss of life's enjoyment. Post-trial motions are still pending. Among all of the medical malpractice verdicts reported by Verdict Search in New York, in 2009, this verdict was the 12th largest.

OUTCOME: $1.2 MILLION DOLLAR DEFAULT JUDGMENT GRANTED

Jorge Lopez was hired by the defendant to cut down a tree located on Bhard Ghandi’s property, in Yonkers, New York. During the course of this work, Mr. Lopez fell from a tree, at a height of approximat ... ely 30 feet, striking his head on a stone wall, and injuring his spine and left arm. Mr. Lopez’s claim arose out of the violations of certain sections of the Labor Law of the State of New York, including but not limited to Sections 200, 240, 241, 241-a and 241(6), in that defendants Carlos Echebia, Moises Mejia, and M And M’s Renovations, Inc. having employed and directed Mr. Lopez to perform labor, failed to furnish plaintiff or erect scaffolding, ladders, hoists, stays, slings, hangers, blocks, pulleys, braces, irons, ropes, and/or other devices as to give Mr. Lopez proper protection. In December 2007, the defendants were served with a summons and complaint. Only Mr. Ghandi answered the complaint. Mr. Ghandi was subsequently dismissed from the lawsuit. Mr. Lopez filed a motion for default as to the remaining defendants for their failure to have appeared. Based upon Mr. Lopez’s extensive injuries, the Court awarded Mr. Lopez $1.2 million dollars, plus post-judgment interest and costs.
