First, write the dispute letter. Then if they ignore the facts you will have a cause of action.

He can file a lawsuit and obtain a judgement. Then he can attempt to attach your non exempt assets.

Yes you can file but it might kill the loan mod. Talk to the lender about it.

Unless you co signed the note for her student loan that debt is hers alone. The same general rule applies with credit card debt except you don't...
