The discharge only applies to your personal obligation to the second mortgage. The lien held by the bank is unaffected by the discharge.

You sound judgement proof. So the judgement creditor will not be able to get anything from you. I can not advise you to skip court that decision...

You can sue anyone you want but it must not be a frivolous action and this might be. better read the fair credit reporting act carefully.
