Oral contract for that amount of money are usually binding. You can file a lawsuit in your local municipal court for breach of contract.

If the opposing party has breached the contract then you have a claim and can pursue any legally available remedy. You need a lawyer.

So you have a bad debt, yes it is deductible for you. Better to consult your tax preparer than a bankruptcy attorney.
