You are NOT eligible for Section 245 Adjustment of Status. The employer's I-140 may get aproved ... but is is useless.

Not unless you are in status. Pending asylum applucation is not a status.
In h1b status, with a denied asylum case, having perm and i-140, could I get h1b stamping outside of USA?
