A client was charged with being under the influence of alcohol while in actual physical control of a vehicle in the state of Arizona. We spotted an issue with the search warrant and filed a pre-trial m ... otion to suppress the evidence collected by law enforcement. At the suppression hearing, the State did not present sufficient evidence to meet their burden of proof, yet the judge still ruled against us. We appealed the judges decision and the appellate court ultimately found that the trial court judge had made the wrong call, and that the government had not met their burden of proof at the suppression hearing. The appellate court sent the case back to the trial court with instructions to suppress the evidence. The case was then dismissed by the government. All charges against our client were dropped.
