Obtaining a full defense verdict in an Arizona state court for a national petroleum distributor after a three week jury trial where the Plaintiffs were seeking approximately $14 million in damages due to the alleged migration of petroleum hydrocarbons onto its property.

• Representing a major mining client in Arizona in the appeal of a permit issued by the Arizona Department of Environmental Quality to the Arizona Water Quality Appeals Board and the negotiation of a favorable settlement for the client.
• Representing a major industrial client in an Arizona federal court and the Ninth Circuit Court of Appeals relating to a challenge under NEPA and NHPA to its acquisition of formerly federal lands.
• Assisting industrial and mining clients with the negotiation of compliance orders, consent decrees, and consent judgments with state and federal environmental agencies under CERCLA, RCRA, the Clean Water Act, and state voluntary cleanup programs and subsequently representing them in litigation associated with consent decrees and consent judgments.
• Representing several clients in cost recovery actions under CERCLA against the former owners of their respective properties and other potentially responsible parties.
• Assisting a major mining client in Arizona and New Mexico comply with local, state, and federal environmental rules and regulations and representing the client while it obtained permits and approvals on the local, state, and federal levels.
• Defending a manufacturing client in an Indiana federal court against allegations that releases at its property contaminated an adjacent property with numerous contaminants.
• Representing industrial and mining clients in the preparation of comments on proposed rulemaking and legislation at the local, state, and federal levels.
• Represent a uranium mining client in Arizona federal court and the Ninth Circuit Court of Appeals in cases involving its mining interests in Arizona.
