I joined Burch & Cracchiolo in 2000 as a shareholder after practicing for sixteen years at Horne, Bistrow & Dulberg P.C. Before I moved to Arizona in 1984, I served as an Assistant District Attorney in the Manhattan District Attorney's Office from 1978-1984, where I tried more than forty felony cases.
Since 1984, my practice has concentrated on construction law and commercial litigation - focusing primarily on helping clients resolve disputes that typically arise out of construction projects. I have represented the entire gamut within the construction industry, from property owners to design professionals, contractors, subcontractors, and material suppliers. I have obtained a jury verdict of more than $3 million in a business tort case arising out of a street improvement project, and defended numerous multi-million dollar construction claims. I have also handled administrative proceedings pursuant to the Arizona Procurement Code and complaints before the Registrar of Contractors. I've successfully defended a $22 Million claim against a pipe manufacturer, successfully defended a $50 Million negligence claim against an international engineering firm, and I've been involved in drafting and negotiating construction contracts from small residential projects to $40 Million commercial projects.
I was recently honored as a Fellow of the Construction Lawyers Society of America. I've been listed in The Best Lawyers in America for the practice areas of Construction Law and Litigation-Construction from 2014 to 2018. I am AV rated by Martindale Hubbell, which is their highest rating for legal ability and ethical standards. I was also named to teh 2014 Top Lawyers List for Construction Litigation by AZ Business Magazine. Also selected for Arizona's Finest Lawyers 2014-2017. I've also lectured to the State Bar of Arizona and various construction industry groups on various construction law issues. I am admitted to practice in New York (1979), Arizona (1984), the U.S. District Court for District of Arizona (1984), the U.S. Court of Appeals for the Ninth Circuit (1997), and the U.S. Supreme Court (2008).
