I can't even begin to tell you how worthless this guy was as my misdemeanor DUI defense lawyer. He refused to listen to my concerns about the officer who arrested me. As it turns out, the officer who arrested me WAS investigated for "profiling" tactics regardling his "stops" and later removed from th...e police force for felony DUI himself!...The officer's name (Mike Rogers) and story was on the local TV news and papers in Phoenix for the course of several weeks. If you are not already familiar with the circumstances regarding City of Phoenix motorcycle DUI cop Mike Rogers then you will probably not believe the rest of my story. This lawyer allowed me to be convicted to the fullest extent allowed despite having BAC readings of only .079 and .083 and absolutely no other aggrivating circumstances (there was no accident, no "priors" and no good reason for the judge to "throw the book" at me.) After the trial, one of the jurors approached my lawyer (Michael Ziton) and actually told him that it was a hard job for the jury to vote guilty beacuse she said they "HAD A LOT OF DOUBTS" Yes, she actually used the word "doubts" after she voted to convict me as guilty. I'm not kidding. Michael was extremely unprepared to represent me in a trial because he would never listen to me to discuss the facts of the case. All he cared about was his understanding of the arrest as it was recorded in the police report. He was not interested in my version of the events. I was extrememly cooperative during the whole arrest because I knew I did nothing wrong, but the police report and officers testimony at trial would have you believe that I was some sort of drunk, uncontrollable monster! THE OFFICER WAS DRUNK HIMSLEF! Officer Mike Rogers was later determined to be an extreme alcoholic. He used and abused alcohol at a chronic level. Most normal people would die or pass-out if their BAC reached 0.30% (3 or 4 times the legal limit for driving) but that it what the cop's BAC was when he wrecked his motorcycle. THE OFFICER WAS ALSO DRUNK IN COURT WHEN HE TESTIFIED! I know you must think I am crazy for saying that but it really is true. It's funny, but I never knew any of this could be true myself until I has ordered by the court to attend Alcohol Awareness classes after I was convicted. I learned about the daily lifestyles of chronic alcoholics who drink 24/7 to maintan a drunken state; HOWEVER, they appear to perfectly normal because that's how they always are. They appear normal beacuse you have never seen them sober. Their bodies would go into a state of shock if you stopped them from drinking. If you don't believe me ask any doctor or expert who treats hardcore alcoholics. Their bodies will shut down if they do not maintain a constant drunken state but they appear to be normal to the average person. So, I'm here to tell you that MZ is a worthless attorney becuase he allowed me to be convicted by a cop who was drunk himself and a jury who admitted they had "DOUBTS"!!! THEN......Mike Z. left the court house immediatley after sentencing but the judges bailiff thretened to have me re-sentenced after the trial. Apparently, everyone expected me to have over $1000 in cash in my pocket to "settle" immediately after the trail. The court made a proverbial federal case out of the fact that I paid my fines on the following Monday rather than immediately after my conviction on Friday. Mike charged my credit card an extra $900 on top of the $4000 I already paid to guarantee that I would not be "re-arrested" when I went back to the courthouse to pay. This laywer did not listen to me. Over and over, Mike refused to listen to me and would only focus on approaching the case based on the information that was presented in the police report. I kept telling him over and over that none of that information was true because it never happened. I kept telling him this over and over and over again.!!! What a nightmare.
