Bryan’s practice concentrates primarily on civil and appellate litigation, employment law, and real estate development.
Litigation. Bryan represents businesses and individuals in a broad spectrum of litigation matters—from commercial contract disputes to land use claims. His litigation practice primarily consists of defense work, with an emphasis on defending governmental entities in constitutional, civil rights (42 U.S.C. § 1983), employment, personal injury, and land use matters. To that end, he has extensive experience with issues involving Utah’s Governmental Immunity Act, as well as state and federal constitutional matters. Although he works out of the firm’s St. George office, Bryan regularly handles cases throughout the State of Utah.
Appellate. Bryan has briefed and argued numerous cases before Utah’s appellate courts. He is frequently retained to handle the appeal in cases handled at the trial level by other attorneys, both in and outside the firm. He has served on the Utah Supreme Court’s Advisory Committee on Rules of Appellate Procedure since 2003. Additionally, he has both written and presented on the topic of persuasive legal writing and appellate advocacy. Before entering private practice, Bryan was a judicial clerk at the Utah Court of Appeals. He maintains an AV® Preeminent™ Peer Review Rating in the areas of Litigation and Appellate Practice.
Employment Law. Bryan’s employment law practice is primarily devoted to representing public and private employers. His representation includes drafting policies, procedures, and employee handbooks; risk management; defense of wrongful termination, discrimination, harassment, and similar claims; wage and hour issues; and assistance on internal investigations. He has twice been named as a “Rising Star” in the area of employment law by theMountain States Super Lawyers’ magazine.
Real Estate and Land Use. Bryan has significant experience handling land use and zoning issues for both governmental and private interests. He also represents developers in all stages of the development process with a particular emphasis on the creation and establishment of planned communities. His projects have ranged from small residential condominiums to large master planned golf course communities.
