Stay away from Boggess

I hired D. Brian Boggess to help with my business matters. I was awarded a judgment against him for monies owed me. He then filed BK and I never got paid. This from an attorney which is supposed to be held to a higher standard. This is one of many instances he had harmed me with. Please for your own ...sake, stay away from this attorney.

I retained Mr. Boggess for a lawsuit in May of 2019. Once he got the retainer, he stopped returning calls, texts & emails. He was unresponsive but I knew other attorneys that knew him. They could get him to call occasionally. On these calls, in 2019, he told me about court filings, process servic...e being completed or about going to court. I later found out that he did not even file the original complaint until January of 2020. This was 8 months after paying the retainer. I spent more time chasing Mr. Boggess than I spent chasing the defendant for the money he owed me. This was double the stress. Mr. Boggess did not listen to me. I gave him the defendants address that I had verified the defendant was living at. He sent the process server to some other old addresses. We never got service and couldn’t continue the case. He then filed motions to extend service time and filed a motion for judgment that we could not get because the defendant had never been summoned or served notice of the lawsuit. He was charging me for all this paperwork and told me that he had been served but, when I finally got copies of the paperwork, I could see that the process server never went to the address I had given Mr. Boggess. I eventually hired a new attorney. Mr. Boggess refused to give the file to my new attorney but, he got copies of filings from the court. He was not able to use any of Mr. Boggess’s work. We had to start all over again. Learn from my mistake, "Avoid this attorney!"

Mother's Estate Never Closed

My mother passed away March 2014. At the time of her death she had paperwork prepared by D Brian Boggess to handle her estate. Mr. Boggess met with myself and my two sisters to discuss the process of settling the estate and said it was a simple estate valued at about $500,000 and should take six mont...hs at most. Over the next two years we discovered that the estate was not being managed at all. Mail was piling up at her house on the front porch. Inside the mail was a notice from the HOA of non payment, property tax bill over due, a check for rent collected for her house in Virginia and repeated calls from creditors to the daughters for things such as equity loan delinquent, funeral bill unpaid and a time share that was being foreclosed. Then while driving by her Vegas residence I discovered her home had been broken into and all appliances including washer and dryer, refrigerator, stove and microwave were stolen. The door had actually been removed from the hinges. This was her home that Mr Boggess was supposedly preparing for sale. It was trashed inside and her personal information stolen. I could go on and on. I would demand update meetings with him where we would discuss issues and he would always say he was working on things and give us dates to expect closure but it never happened. It is almost three years since my mother's death and her estate has not been closed. He moved from Vegas back to Utah without letting us know and we found out he was being disciplined by the Nevada Bar and was suspended. Now I see he is active again. I am in the process of filling a complaint with the Nevada Bar. Please think twice about using him for any purpose.
