Brett talked me into pleading guilty with the assumption that after sentencing we were going to appeal my case at which time he quit on me saying that I could find better counsel to represent me.
Thank you for your input and I'm sorry you weren't satisfied with the outcome. I did recommend that you take a plea bargain after we had fought your case harder than any other I had ever fought and had put more time into your case than any other I have had in my career. After the evidentiary hearing called the preliminary hearing, the motion to suppress we filed and subsequent hearing on the motion to suppress, along with multiple pretrial hearings later, I did recommend that you take a reduced charge because the State was willing to dismiss several other charges rather than take the matter to trial. Often times when a case is not worth taking to trial because of the risk of conviction of a greater charge I do recommend that a client consider taking a plea offer by the state. In this case we did get reduced charges and a dismissal of many others so in my legal opinion a plea offer was what I felt would be best. After the plea was entered and it came time to file an appeal on our denial of the motion to suppress I recommended that you contact attorneys who specifically handle appeals. There are many attorneys in Utah who specifically handle the appeal of criminal convictions and since that isn't my specialty I did recommend that you explore your options.
