Ms. Trupiano’s male client not only wanted to marry his Chilean fiancé but he also wanted to sponsor her for her legal permanent resident application through the marriage. If she later, within 10 years or her becoming a United States citizen, did not have sufficient funds to support herself and sought public benefits, the government would want Ms. Trupiano’s client to pay for her needs. This could even be expected of the United States citizen spouse even if the marriage in the meantime failed. So Ms. Trupiano prepared a prenuptial agreement that also imposed in the most legally enforceable way conditions on the future wife to prohibit her from using that financial sponsorship of her immigration application later as a way to obtain support from the husband unfairly.
