On August 29, 2013, plaintiff Isaias Munoz, a painter, was working for a subcontractor at a three-story residence th ... at was under construction in Houston. The house had an elevator shaft, which was empty. Munoz was working on the second story when his foreman said he wanted him to paint some trim on the the third story inside the door frame to the elevator. While on the third floor, Munoz stepped through the door to get a better look and fell to the bottom of the shaft. He sustained multiple injuries. Mr. Munoz's injuries included a knee patellectomy, arthroscopy, debridement, fracture of his patella which required internal fixation and open reduction. He also injured his lower back and sustained a herniation at his L4-L5 level, which required multiple epidural steroid injections.
