Down Payment Litigation

A real estate contract to purchase a high end condominium apartment in Manhattan was terminated by the buyer, due to the seller's mistake about the expiration date of the tenant's lease. The seller's ... attorney refused to return the buyer’s down payment in excess of $200,000, claiming that the buyer breached the contract, and therefore the seller was entitled to keep the down payment. I sued the seller and the seller's attorney for return of the down payment and additional expenses incurred by the buyer in connection with the terminated real estate transaction.
