OUTCOME: Several months after commencing litigation, I recovered 100% of my client's down payment in excess of $200,000 plus additional monetary damages.

A real estate contract to purchase a high end condominium apartment in Manhattan was terminated by the buyer, due to the seller's mistake about the expiration date of the tenant's lease. The seller's ... attorney refused to return the buyer’s down payment in excess of $200,000, claiming that the buyer breached the contract, and therefore the seller was entitled to keep the down payment. I sued the seller and the seller's attorney for return of the down payment and additional expenses incurred by the buyer in connection with the terminated real estate transaction.

OUTCOME: The lawsuit was discontinued and the notice of pendency was vacated, thereby permitting my client to sell the house to another buyer.

The purchaser of a house in New York City was unable to get a mortgage commitment within the time period specified in the contract of sale, or within the additional period of time granted by the seller ... . Although the purchaser’s bank did provide an informal loan approval, it did not issue a formal mortgage commitment. When the seller refused to further extend the purchaser’s time to obtain a mortgage commitment, the purchaser commenced a lawsuit for specific performance of the real estate contract. In addition the purchaser filed a notice of pendency, which prevents the seller from selling the house to anyone else during the course of the litigation. As the litigation attorney for the seller, I made a motion to the court to dismiss the purchaser’s action for specific performance. After reading my motion papers, the purchaser’s attorney voluntarily withdrew his lawsuit, and vacated the notice of pendency.
