Contact a law firm that regularly assists with EB5 filings. They are extremely complicated and have many risks for you and the attorney.

Waivers can only be filed once USICE or USCIS has issued a denial or notice to appear. Contact a US immigration attorney prior to filing.

If filed within the 60 days, technically not out-of-status. Even if you were, AOS with a US citizen spouse will "forgive" any status issues. ...
