Daniel C McAuliffe

I have been licensed attorney in Colorado and the District of Columbia since 1997.  I currently practice corporate, federal contract and environmental compliance law.

As a state government attorney for 13-years I practiced natural resources, energy, water, labor, contract, construction and administrative law.  I am a Judge Advocate in the US Army Reserve with a Top Secret security clearance.  As an Army lawyer I have practiced contract and fiscal law; international, operations and intelligence law; criminal law; civilian labor law and provided legal assistance to Soldiers.  I was a Legislative Director for a US Congressman and US Senator; skilled in legislative procedure, election law and federal administrative and regulatory law.  I am an effective communicator with an easy-going style and outgoing personality. 

As a US Army Judge Advocate and as a General Counsel for a state natural resources agency I have served as an attorney-advisor to commanders, senior executives, boards, commissions and other decision-making bodies. I have also served as a hearing officer and as an investigating officer.  I have also helped thousands of Soldiers resolve their family and estate law related problems. I have also administered trusts, including the preparation of annual tax return filings.

I have supervised the filing of cases in state and federal courts. I am skilled in district court and appellate litigation, including drafting of pleadings, motions, and briefs; drafting written discovery and taking depositions; negotiating settlements; developing trial and appellate strategy; and presenting oral arguments.

I routinely review records to assure pertinent law, regulations and rulings have been properly cited and applied; I review briefs and position papers for legal accuracy and to determine whether the reasoning and analysis are supported by substantial evidence.

I have worked on complex jurisdictional issues and presented the issues and my recommendations, which are based on my review of statutes, regulations and court decisions, to commanders, boards, commissions, courts and legislative bodies. 

I review pre-hearing motions, subpoenas, requests for expedited judicial review, remand orders, and I have prepared recommendations regarding these matters.  I have prepared analyses integrating procedural and evidentiary documentation to show the nature of a case; the bases for jurisdiction; the bases for the parties' positions; applicable laws, regulations, policies and other governing criteria.  This analysis is the basis for my written recommendations.  I have prepared legal opinions incorporating case findings.  I have also written position and policy recommendations that are the foundation of future administrative and adjudicatory decisions.

I have trained others, including other attorneys, regarding legal, technical, and substantive aspects of preparing for a hearing before a board, commission or other decision making body.

I have acted as a mediator to facilitate the early resolution of cases through an exchange of documentation and by looking at issues from a variety of perspectives.
