Client was involved in a single vehicle accident and was subsequently arrested for driving under the influence of drugs. Blood test from lab yielded a result that led DA to offer straight plea to the ... charge. After reviewing nearly 700 pages of evidence from the lab, we believed that the blood test had significant issues surrounding the chain of custody and reliability. We proceeded to a motions hearing, and the court after hearing all the testimony without argument, immediately suppressed the blood results finding that there was no evidence that the blood test was in fact the client's, and that the results were unreliable. The prosecutor now has no evidence to proceed forward to trial.
