DB was charged with destruction of property (DV). Prosecution offer was to plead to the charge. He had a pending Deferred DV in another jurisdiction in Colorado. Had he been convicted or pled guilty he ... was facing 2 DV convictions, losing his military job, loss of possessing or owing a weapon and a jail sentence in the case in which he got a deferred previously. The jury returned a NOT GUILTY verdict within 10 minnutes.
OUTCOME: Client's probation was not revoked. After 16 months and obtaining about 4,500 pages of discovery all 8 counts dismissed by DA. DA admitted unable to prove any violation of probation even at the civil standard of proof (preponderance of the evidence).

The jury returned a "Not Guilty" verdict is less than 30 minutes. The prosecution put on over 15 witnesses. My client is a City employee and would have definitely lost his job if he plead or was found ... guilty. Over 5 witnesses identified my client at being at the scene of the alleged crime. We had only 3 witnesses (including my client). Four other co-defendants had already plead guilty. My client was the sole hold out. Through out the trial, my central theme was that all these prosecution witnesses could not have seen what they claim when over 40 to 50 people were also involved in fighting at a wedding party and they were just too far away. Through a very rigorous cross. examination, I showed that none of these witnesses actually saw any physical act to indicate that the client was actually fighting. He was charged just because he took a ride back with his cousins. The training I received from Gerry Spence and the National Criminal Defense College helped me immensely in presenting a winning case to the jury.
OUTCOME: "Not Guilty" of DUI
After a 2 day jury trial, the jury found the client "Not Guilty" of DUI.
