This is a Dependency or Neglect case. Mother had custody of child. DHSS filed a Petition in Dependency or Neglect against both parents. My client, the father, had nothing to do with the reasons for DHS ... S filing Petition. A few months after filing, the child was removed from mother's custody and placed with father who was on probation in an unrelated criminal matter. DHSS caseworkers were coaxing my client, the father, to admit the client was dependent or neglect but no fault as to him. After I reviewed all the facts of the case I believed, in my professional judgment, the People would not be able to prove the claims as to my client. My client was successfully keeping the child safe and doing everything he was supposed to be doing. Case was set for trial after I explained to client that if he can avoid an adjudication of dependent or neglected child as to him was far better than simply admitting when the proof against him was so scant. After several months, at the settlement conference the People decided to allocate full parental rights and custody to my client with very limited visits for the offending mother and case was closed WITHOUT any adjudication as to my client.

Client did not want to plead to a drug charge because of collateral issues. We were hired. We reviewed all the discovery and the medical records of client history and of the day of the alleged incident. We consulted with an Internal Medicine physician and found out that client was experiencing a diabetic coma. We convinced the DA to plead only to resisting arrest DJS. The obstruction and Felony drug charges were dismissed. Client agreed.

At the ICWA proceedings the Court agreed with us that father should get custody of the child and the case was transferred to the jurisdiction where father lived, which was in another state. Father, my client wanted this outcome as the other jurisdiction had already awarded custody to him while the Colorado court proceeding was on going. There was no adjudication of dependency or neglect against my client.
