Police gained entry to home without warrant by threatening to break down door because they smelled marijuana; defense objected to the search and the Court suppressed evidence recovered during search. ... The defense argued that the search was invalid under Howe v. State, a Nevada Supreme Court decision, in which the Court found that the mere hypothetical concerns about evidence destruction does not justify warrantless forced entry into a home. The District Court upheld the decision in favor of the defense.
OUTCOME: Court dismissed before preliminary hearing; Court voided probable cause determination upon presentation of truth by the defense. Defense counsel represented his client in custody case and got District Attorney disqualified.
