Allstate's insured's car was stolen. It was recovered within a week with damage and missing parts. Allstate refused to pay for the $9,600 damage to the car, claiming that their insured was complicit ... in the claimed theft and damage. A two week jury trial resulted in a verdict for Plaintiff for $87,000.00. This was the first known Insurance Fair Conduct Act case tried to verdict in Washington state. Although Plaintiff is still awaiting the final ruling of the trial judge, it is estimated that with costs and attorney fees, the final judgment will far exceed $500,000.00
