If the executor did not properly distribute the estate according to the will it might be time to consult a probate attorney who does litigation.

Using a credit card of a deceased person can cause harsh consequences. I’d recommend paying the bill and stopping use immediately.

The cleanest way to accomplish this is to simply distribute $5,000 to all beneficiaries (assuming their interest is at least $5k).
