Yes, you should be able to use the same I-130 approval.

You can now do the I-601 waiver in the US before they leave to minimize the amount of time they are stuck outside the country.

Does he have to file form 601a? He came to US on a B-2 and overstayed. His authorized stay ended September 17, 2009.

Yes, you can, but consult with an attorney first. Make sure that adjustment in the U.S. is not a feasible option.
