It is not unusual for the I-94 number on the I-797 to be the same or similar to the one issued at the port of entry.

The I-94 controls the amout of time that you can stay in the US. The I-94 card rarely exceeds a 6 month stay, so I suggest getting legal advice...

1. Technically you are in H-1B, but you are not complying with the terms of the status. But since you have a valid I-94 your are not accruing...
