You should check for registration of the name with the Secretary of State of Texas. You may also have a Trademark issue as others have mentioned....

Have you contacted him about this? I do not know what communication looks like but you can likely solve your issue with a cease and desist letter....

As the court stated in a Google Books case, it is on a case by case basis but notice they do not attempt to resell it....
