He files the petition abroad and if he does not have sufficient income then you two get a co-sponsor that is a legal permanent resident or us citizen.

Yes but you must submit the petition after 60 days from his entry and BEFORE his I94 expires.

This is very common with USCIS. Just try filing the change of status again or call the 800 number to let them know.
