OUTCOME: Death sentence vacated, life in prison

I worked with David Sergi for a number of years on Gene Hathorn's case. After being convicted of capital murder in 1985, the jury was not allowed to consider evidence of his abusive childhood under the ... jury instructions submitted at the time. After working its way through the state and federal courts for a number of years, Mr. Hathorn's death sentence was vacated and a new punishment hearing granted in a 9-0 opinion by the Texas Court of Criminal Appeals in 2009.
