OUTCOME: Protective order application nonsuited (dropped) by State 20 days after filing date.

This was a protective order proceeding in which I represented the Respondent. I compiled and presented evidence that called the Applicant's credibility into question and convinced the State to drop the ... case without client's having to undergo a protective order hearing. Concerningly, the Applicant accused the Respondent of sexual assault. Applicant would have been a witness in Respondent's criminal case that was dismissed 6 days earlier for insufficient evidence.

OUTCOME: Unearned legal fees refunded by attorney to former client 6 days after mediation session.

Provided remote, pro bono assistance in compiling evidence to support a request for a full refund of paid legal fees. Attorney in question misrepresented that application for naturalization (Form N-400 ... ) was completed and submitted to USCIS and that a receipt notice was pending. Application was never submitted and attorney refused to refund unearned legal fees, giving rise to the former client's request to participate in fee dispute mediation through the New York County Lawyers Association.

OUTCOME: Cases dismissed 1 month after arrest for Assault Bodily Injury - Married/Cohab and Interference with Emergency Request for Assistance. Language barrier and inadequate translation tools created misunderstandings between police, client, and his partner.

Both charges were dismissed after submission of detailed affidavit of non-prosecution, along with pointing out the lack of police officers who speak client's language and the unreliability of Google Tr ... anslate when no interpreters were readily available.

Given the facts and other circumstances, I tried this case in court before a judge, rather than a jury (with the State's required consent). Through cross-examination of the State's witnesses, I was abl ... e to obtain a judgment of acquittal ("Not Guilty"). Issues involved inconsistent statements and lack of physical evidence.

OUTCOME: Name change and additional findings granted in final divorce decree (under exception in Section 45.103(b)(2) of the Texas Family Code regarding criminal history). Prior Petition for Name Change denied on basis that client did not meet legal requirements.

Submitted brief persuading judge to grant a change of name as part of divorce. A prior Petition for Change of Name was already denied on the basis that client did not meet the requirements of Section 4 ... 5.103 of the Texas Family Code. Brief successfully demonstrated that client always met these requirements and that granting a name change would be to the benefit of the client and in the interest of the public. Client needed this name change as part of final divorce decree in order to fulfill the Texas Department of Public Safety's (DPS) identification requirements to obtain a Texas driver's license. Not only did judge grant the name change, but the judge also made additional findings to explain the difference between client's name on birth certificate and the name that appears in other personal identification documents.

OUTCOME: Lifetime protective order granted where applicant was harassed and stalked by former partner, who violated standard protective orders issued in the past. Presented case in court as supervised intern at Comal County Criminal District Attorney's Office.

Under supervision of Comal County assistant district attorney, I successfully argued for the court to grant a lifetime protective order. The applicant and his current partner were routinely harassed an ... d stalked by his former partner, who had a history of violating previous protective orders that lasted for only two years. I prepared witnesses for questioning, conducted questioning before the court, and introduced exhibits into evidence.
