Client's blood draw showed a Blood ... Alcohol Concentration of .18, almost two and a half times over the legal limit. An aggressive cross examination of the arresting officer during the contested motion to suppress, showed that even though the officer believed Client was possibly intoxicated, without more evidence, his stop was illegal. Because the stop was illegal the court ruled that any facts or evidence of the stop could not be used in trial. The state was forced to dismiss the case that day

When the officer had Client exit for testing, the Client had difficulty standing and almost fell several times. The officer arrested Client. During the half-hour drive to the magistrate's office, Client fell back asleep in the back of the police car. In the video room, the camera recorded client mumbling, slurring, wobbling and having difficulty just standing.
