After ... argument, a motion to suppress was granted and the case dismissed after the Judge agreed with Defense argument that the continued detention required additional Reasonable Suspicion and that the length of detention was unreasonable and a violation of clients 4th Amendment Right against illegal seizure/search. Case was dismissed and client was able to keep his commercial driver's license.

It was argued after a review of the evidence that the facts and circumstances of the alleged consent was a violation of his 4th amendment rights. It appeared from the evidence that client's consent did not amount to being voluntary due to the circumstance involved in the detention.

Client was detained for a minor traffic violation. Arresting officer requested consent to search client vehicle due to being in an alleged high drug traffic area. Arresting officer claims that consen ... t was given and during the search a controlled substance was found and client arrested for a 3rd degree felony and possession of a firearm. Client punishment range was 2-10 years. After reviewing the video and other reports, clients cases were dismissed based on a violation of the 4th Amendment (illegal search) as the search was deemed outside the scope of the alleged consent given in violation of the 4th Amendment.
