Aggravated Sexual Assault - Child
Nov 29, 2010OUTCOME: DISMISSED
My client was accused of 5 counts of Aggravated Sexual Assault. The complainant was 12 years old when she made the allegation. My client was her 2nd step-father. Complainant told her biological fath ... er that the sexual encounters occurred during the years the 1st stepfather was in her life, however, she indicated it was my client that was the molester. Unbeknownst to her, going back, during those years, my client had not even met her mother yet. We pursued a trial and after a year and a half, on the day of trial, the State dismissed the case. Due to trial preparation of witnesses and repeated persuasion, the prosecution decided they could not prove their case.
