I signed a contract yeasterday where the attorney gets 40% and with the remainder I pay the doctor & keep the rest.Is this fair?

Who told you that the attorney should get 33%? The 40% contingency fee agreement is very common in Texas.

My ex husband ran up bills in my name while we were separated. I did not find out til the divorce was final.

If he remarries then his property goes as per the intestacy laws of Texas which would go to his spouse.
