The Cape Fear Attorney

Mr. Humberto Saldana Is the perfect example of why Cape Fear should be based on a True story. He was my court appointed Attorney and he never came to see me the entire 3 months i was incarcerated. My family called him relentlessly to discuss my case to make it clear that the accusations that i was ch...arged with...by an ex girl friend..were false. She even wrote an advidavit...wrote a statement to the District Attorney..The Prosecutor and even to the SAPD officers who came out to file the report. Completely retracting her Statements that she was drunk and had no clue who caused her injury. Ok well after completely not showing up on my first court date...causing me to be reset... He informs me they are offering me 6 years on an aggravated case Deferred. But if i pay my fines and finish my classes i can be off of probation in 2 years felony free. Lie number one. There is no early realease from probation on an aggravated case. It’s day for day the full lenthg of your plea. He then tells me that if i plea the agg case my other charges would be dismissed lie number 2. Not one single of my others charges were dropped. Then he tells me that the prosecutors were requesting a TAIP evaluation and psychological. What he failed to mention was the 160 days in lock down mental facility on top of the 6 years. I had find that out from other lawyer at my other court date to face the charges that were supposed have been dropped. So when i go in front of the judge Mr Humberto’s 6 years have magically turned into 8. He actually went to over to the prosecutors to nagotiate my plea and came back with more years than he started frim, lie number 3. this dude knew my i had just my grandmother and gave me more grief counseling than legal counsel. This dude lied about everything even saying that the prosecution had evidence against me they didn’t when i expressed my concern over taking the deal at all when my girlfriend retracted and wasn’t even present in court.He is a useless a a condom with holes in it. And he couldn’t have gave a care less that his incompetence caused me to miss Christmas and New Years without my kids and without my granny’s for the first time. Because he was off living his best life on vacation captizaling on a system that is totally set up for Individuals like Mr. Humberto to profit off of those whose only crime in real is not being able to offered a defense. If your love one is unlucky enough to have him as a court appointed and you can’t afford to pay him under the table enough to care. Your loved one is better representing themselves.

Because this client, if it was a client, chose to hide under a pseudonym, I cannot address this person fully. As far as this reviewer stating that I lied regarding his/her case, that is false. I do not lie or misrepresent to my clients what the State has against them as far as evidence or what the State may be offering in a plea deal. To do that would not be beneficial to my client or myself. I understand that this reviewer stated that the girlfriend retracted her statement regarding what allegedly occurred. That information may help a client or it may not; that call is completely up to the State. A victim may change/retract/deny alleged charges, but if the State decides to pursue the case, again, that is the State's call, not mine. As far as "living my best life on vacation", I have not been on a vacation in over three years; wish I could say differently. Avvo is a great place for potential clients to get info when hiring an attorney, but it is also rather unfair/biased as Avvo does not verify that the reviewers are actual clients, nor does Avvo get verification/facts before posting such negative and untrue statements for reviewers that may or may not be real. I would like to finish with what I have seen in the past when a client is more harshly sentenced then they would like to be; they blame the lawyer and take zero responsibility for what may have gotten them in to the criminal justice system. I ALWAYS do my best to either get the charges dropped for my clients or get the best possible outcome for them; this is in my clients best interest and mine, as I appreciate referrals for hard work.

Money hungry

I retained Mr. Saldana for 800$ . He did 4 resets, 2 by telephone. He fired me when I went with $300 bond instead of him bonding me out for $500. I do not feel I was represented or defended in anyway for what I paid.

I am sorry you feel this way. I want to respond to this review as it unfairly misrepresents actual facts. I withdrew as your attorney because YOU failed to make payments towards your case. In fact, five months went by without a payment towards your balance and I continued to represent you. I understand that clients have bills to pay and a life to lead, but I as well have bills and a family and I cannot work for free. I also remember the comment you made after the court hearing in which the judge granted the motion to withdraw; you stated you were going to "cut" me. Spaces such as Avvo, are a good place for potential clients to get reviews before hiring an attorney, I wish such a space existed for attorneys to review clients. It would be beneficial to know if a client was prompt when making payments toward agreed upon legal fee and it would be beneficial to know if a client had the capacity to make violent threats/comments.

Great Result!

I hired Mr. Saldana based on a recommendation -- "really good attorney, but sometimes not easy to reach." Working in the legal field, I know first hand that an attorney cannot always get back to a client immediately or even on a same day basis, so this was not a big deal to me. Unfortunately, some c...lients seem to think they are they only one. The most important thing for me was hiring a competent attorney, and someone who was recommended. As for my legal issue, short of getting the case dismissed, Mr. Saldana was able to get a Class A misdemeanor (up to a $4,000 fine, 1 year of probation, 24 hours of community service, and taking an 8 hour class) down to a Disorderly Conduct (Class C) with a $450 fine and court costs. No community service, no classes, and deferment after fine is paid. I am ecstatic, as a Class A or Class B misdemeanor would have possibly cost me my job. Mr. Saldana was willing to "go all in" with our pocket pair of 2's on the Prosecution's King, Ace high -- we announced ready for trial and were set to go. With my consent, Mr. Saldana indicated that I would accept a much lesser charge, one that had not even been offered. We got the full house, and the Prosecution folded. Nice job, Mr. Saldana. I am extremely pleased with the results. It's always reassuring when other, more senior attorneys in the courtroom tell you, "You have a good attorney. You are in good hands with Humberto. " I would highly recommend Mr. Saldana.

When i hired Mr.Saldana from the first time i spoke to him i know he had my best interest at hand. After fighting my case over 20 months and numerous times we went to court he finally was able to accomplish what outher lawyers weren't able to do and said couldn't beand done all other lawyers wanted m...e to take the first plea cause that was my best bet. I spoke to several other lawyers before and after talking to Mr. Saldana but in the end hired Saldana and am very satisfied with the outcome being put on 4 yrs probation and after 1 1/2 yrs i messed that up i called and he was there on first call helping me again with no hesitation. Even helping me financially paying payments cause lots og lawyers want lump sums and we all know how that can get when fighting legal matters he as always helped me..And i can speak for numerous people that i have recommended to Mr.Saldana and have hired him not one of them have been let down or not satisfied by his way of handling there case..Thank you once again for helping me over and over..

Poor Communication

While initially Saldana was helpful, within a month of us hiring him he began to become less responsive. There were a few court hearings, and he only showed up prepared to the first one. After the first court hearing, we had to keep copies of all the paperwork and make sure to bring it because Saldan...a would always "forget". He was extremely rude after the first month or so and would constantly pressure us to plead guilty despite having an extremely good case. We ended up dropping him because we couldn't get a hold of him for almost two weeks despite calling almost 10 times over that period. When he finally answered, he agreed to meet us. When he met us, he asked for payment. We paid him, he "had to go", then we couldn't get a hold of him again.
