The concept of a products liability allows a consumer to recover for harm caused by a defective product. It is traditionally required that a plaintiff prove that (1) the injury or harm resulted from the defective product and (2) that the product was in fact defective when it left the hands of the manufacturer. A manufacturer of a product should be held accountable when a consumer uses a product in the manner in which it was intended to be used but is harmed or injured by the product.

Best call I ever made

10 years ago if you would have asked me "Do you know a good lawyer?" I would have said no and at the time, never thought I would have needed a lawyer. As time would prove different! I now think everyone should have a lawyer and if you are so blessed as me. I hope you end up with Toby Fullmer. From th...e very first call, he confidently, calmly, empathetically listened and guided me through a process that I had no clue about. Now, I've used him twice, once for a litigation case and another for a startup business contract. Today, if you were to ask me. "Do you know a good lawyer?" I will calmly and confidently guide you to Toby Fullmer!

“Unprofessional and “Incompetent Representation — Do Not Recommend”

In my experience, his representation was far below what I expected. He never filed motions or sought a protective order despite my repeated requests. He spent over an hour on a call with opposing counsel but would not explain what was discussed, only saying opposing counsel was “a really good attorne...y.” He repeatedly told me I could not afford a lawsuit, often adding this to emails with opposing counsel, which weakened my position. Opposing counsel offered a 2018 Audi with an $18,000 balance toward my $46,000 claim essentially asking me to assume my former partner’s debt with zero equity. Toby called this good negotiating which confirmed to me he was not acting in my best interest. I was encouraged by Toby to negotiate with someone who had impersonated me, attempted stealing my packages by rerouting them, used my SSN, and lied about everything, including his address. After raising my concerns, we mutually parted ways. I hired another Law Firm for $500 an hour which is $150 an hour more than Toby's rate and I'm currently in a lawsuit with my fraudulent former business partner. Based on my experience, I do not believe he provided competent representation and I would not recommend him.
