In Texas, Harris County, does an HOA or POA have to have non-profit status from the IRS to be a legal HOA or POA ?

The validity of a HOA or POA does not depend on its IRS classification. The non profit status is merely for more favorable tax treatment.

They are similar. Home owners association "HOA" are normally homeowners in the development and property owners association "POA" include homeowners...
