she should probably go to the U.S. Consulate in Japan and apply for an emergency travel authorization.
After my 10-year ban for overstaying has passed,can I just just apply again for a tourist visa or do I still need a waiver ?

you don't need a waiver, and you can apply for a tourist visa. But I doubt it will be granted in this case.
