It is up to you. You would like to file your change of employer petition via premium process to minimize the period of your unauthorized stay.

If the employer withdraw the pending H1B application, the employer won't be able to apply until 4/1/2013. Please consult with an employer's attorney.

A new employer can file a H1B petition for you. It has to be for consular process.

Your prospective employer can file a H-1B petition for consular process. You can not change your status to the H1B.
