Plaintiff warehouse shipping clerk was assigned to rebuild a dropped ceiling in the company office. He was not supplied with proper safety equipment such as a scaffold. He had to use an A-frame ladde ... r which failed to prevent him from falling when he lost his balance when he received an electric shock. He fell onto his buttocks 5 feet down and suffered a burst fracture of the first lumbar vertebra which left him with a severe neurological condition called cauda equina syndrome. He was permanently disabled and suffers bowel, bladdert and sexual dysfunction. Suit was brought against the property owners under NY Labor Law 240, known as the Scaffold Law. The case settled in Court before trial.
