O ... ur office has resolved cases where the police investigation had initially placed fault on our clients. Investigation in those cases allowed for our clients to recover damages for their injury. Our office recently resolved our third case involving drivers crashing into the side of an 18 wheeler trailer. In each case, the initial finding by the investigating police agency blamed our client for causing the accident. The dynamics of the cause of the accident were not understood by law enforcement. In each case, the 18 wheeler trailer was blocking a rural road at night. The trailer was blocking the oncoming lane of traffic. The driver had no opportunity to avoid crashing into the trailer blocking the roadway. Many studies have shown the driver had no chance to see and stop in time to avoid hitting a trailer blocking the roadway at night. Many factors may come into play, but the bottom line is that if a trucker elects to block an oncoming lane of traffic at night on a rural highway that the risk to oncoming traffic is severe.
