In order to use Head of Household filing status you need to be considered unmarried for the tax year and pay more than half of the living expenses...

They can seize the money in a bank account if they know where the bank account is. If you give the money to your children they can still seize it....

This is not a reportable federal gift and new Jersey does not have a state gift tax. It is not an inheritance. You should be ok.
