You can file the I-130 whenever you're ready, but obviously the sooner you file and are approved, the sooner you can apply for the waiver.

Your card should say what it is - conditional permanent resident if you were married for less than 2 years when you got your permanent residence....

The government isn't always right and you need someone to work on your behalf to make sure 1. They are wrong and 2. Convince them they're wrong....
