Marianne G. Robak is a senior associate attorney in McCathern’s Houston office. Ms. Robak is an experienced litigator who handles business disputes, commercial litigation, and corporate fraud in both federal and state court for local and international clients. She has served as lead trial lawyer on matters ranging from complex breach of contract claims, fraudulent transfer claims, partnership disputes, banking litigation, bank fraud, trade secret violations, real estate fraud and other property disputes. She also handles business disputes among import/export businesses relating to shipment in to or out of the Port of Houston. She has successfully participated in jury and non-jury trials, evidentiary hearings (such as temporary injunctions), summary judgments and appeals.
In 2013, she obtained a temporary injunction on behalf of a Fortune 500 company that enjoined an adverse party from transferring millions of dollars in assets by proving that the assets had been fraudulently transferred in order to hinder or delay Ms. Robak’s client from recovering on its breach of contract claim. In order to prove that the assets being enjoined were fraudulently transferred, Ms. Robak had to trace the assets through several different entities, banks and title companies and show that there was not adequate value exchanged for each transfer. The injunction froze all of the assets, including the business owner’s homestead, pending the final outcome of the trial. The adverse parties appealed and, on appeal, the 14th Court of Appeals upheld the injunction order. Ms. Robak’s client ultimately obtained a very favorable settlement payment from the business owner.
In addition to her litigation practice, Ms. Robak also acts as “outside general counsel” for many small to medium-sized businesses throughout Texas, assisting them with business transactions, contracts and employment issues, as they arise.
Ms. Robak received her Juris Doctor from South Texas College of Law Houston. During law school, Marianne was selected as a member of its top ranked moot court team, where she competed in five national advocacy tournaments. Upon graduation, she was admitted into the prestigious Order of the Barristers.
In her free time, Ms. Robak enjoys traveling, camping and hiking with her husband and two children. They are on a mission to visit all 61 U.S. National Parks!
