Excellent Trial Lawyer

Paul is an excellent lawyer generally - however, he is a elite trial lawyer. I have known him for approximately 10 years and have regularly worked with him in litigation matters - mainly oil & gas, corporate or contract disputes. Officer Representation, Settlement Negotiations & Agreement

I became acquainted with Paul as he was engaged by my business partner (and fellow officer in our corporation), to represent him in a suit. The suit was as a result of the plaintiffs choosing to join the officers in addition to their alleged claims against our companies. It was particularly offensi...ve with DTPA claims which were false - and the inclusion of many parties that simply had no involvement with any of the facts and circumstances. Our D&O provider placed a limitation on the number of counselors our policy would be able to cover. My partner and I chose a common sense approach of instructing my own counselor (engaged in my capacity as an Officer) to attempt to work collaboratively with Paul on a solution which was amenable to the insurer and their limits of coverage, while ensuring that work done by Paul was not wasted or not leveraged for the benefit of the end goal - making the suit go away. I was genuinely impressed by both men's capacity to put the client first and find a solution which was a win:win to their needs an in line with the insurer's requirements. It would have been perfectly easy for all involved to look out after their own interests, fees, etc. - none of that happened. Subsequent to all of this, our corporate counselors who were engaged in this matter by being uniquely qualified to have a local feel of the lay of the land in South Texas, needed more detailed contractual support which was comparatively much more of Paul's expertise. I witnessed again, what could otherwise be a herd of cats (legal cats that is), be artfully managed and effectively shepherded by Paul in a way that was amenable to everyone. There was no offense taken by any of the parties, no extraneous waste of time and dollars. Paul wound up expertly completing the task of an effective settlement agreement with the Plaintiffs who were particularly challenging with a series of back and forth(s) which became tedious and at times seemingly counterproductive. In the end, the agreement absolved our companies - and each of us in our capacity as officers. I believe that Paul's tough but fair minded pragmatic style enabled a settlement with the plaintiff - saving our company, our insurer, and moreover everyone's time which is valuable. Paul is precise and appropriately respects the importance of both accuracy of facts and personal nuances of the parties involved.

The Case of the Divorce, Foreclosure, Excess Proceeds and the New Ex-Wife!

When I divorced in 1988, my ex-husband got our marital home as part of the property settlement and I signed a Quit Claim Deed in his favor (although he never recorded it). In December, 2010 (22+ years after our divorce) I learned that my ex-husband had let the property go into foreclosure. Because ...he had never re-financed, I will still a co-borrower on the mortgage and a co-owner in the Deed records. And, to complicate matters, my ex-husband had since re-married, divorced, and given 1/2 of the property to his new ex-wife in their property settlement. The lender foreclosed, sold the property at auction, and there was a substantial amount of money left over from the sale of the property. Because I had agreed to give my ex-husband the property in our divorce settlement, I was certain I was not entitled to any of the excess funds from the sale of the property. But wait...I was still an owner according to the Deed records. And, I because my credit history was damaged as a result of the lender reporting the foreclosure on my credit report, I felt I should be compensated for my ex-husband's failure to re-finance and/or make the payments on time. And, not being an unreasonable person, I was willing to share the excess funds with my ex-husband's new ex-wife. Paul reviewed my Divorce Decree, determined that my ex-husband was negligent, and successfully argued my case. My ex-husband's new ex-wife and I split the excess proceeds and he got what he deserved...nothing! Paul counseled me as to my options, helped me keep my emotions in check when making decisions, and kept my in the loop throughout the entire process. I had been told by two other attorneys that my case was hopeless and that I should let it go. That's when I contacted Paul. He was honest that it wasn't going to be easy, but he wasn't intimidated by the hard work he knew it was going to take. Paul spent countless hours researching case law and how to successfully present my case. And, he did ALL of this for a very reasonable fee! I reflect back on my case from time to time and I'm still AMAZED at what Paul was able to do with an otherwise hopeless situation. Needless to say, I'm still Paul's #1 fan!
